Terms of Service

1. Agreement to these Terms

These Terms of Service are a contract between you and Robert Theodore Torres, a sole proprietor doing business as Literary Agents (“we,” “us”). By using writewiththegreats.com or any part of the service, you agree to them and to the Privacy Policy. You must be at least 13 years old, and old enough to form a binding contract where you live; if you are not, a parent or guardian must agree on your behalf.

2. The service

Literary Agents provides AI writing companions — “agents” — that respond in the manner of great literary styles. Conversations are generated by AI language models. Free usage is limited; paid subscriptions raise the limits as described on our pricing page. We may change, add, or retire features (including specific agents) as the service evolves.

3. Your account

Sign-in is by one-time email link, so your email account is the key to your Literary Agents account — keep it secure, and tell us promptly if you suspect unauthorized access. You are responsible for activity under your account. Provide a real address you control; we may suspend or terminate accounts that violate these Terms.

4. Plans, billing, and cancellation

Pro is a subscription billed by Stripe: $8 per month, or $80 per year. It renews automatically at the end of each billing period until you cancel. Cancel anytime from the billing portal on your account page; cancellation takes effect at the end of the period already paid for, and you keep Pro access until then. Prices may change; if they do for an existing subscription, we will give you at least 30 days’ notice by email before the new price applies. Taxes may be added where required. The free tier’s limits may be adjusted from time to time.

5. Refunds

Subscription fees are non-refundable except where the law requires otherwise, and partial billing periods are not refunded on cancellation. If something on our side went genuinely wrong — a billing error, a service failure — write to hello@writewiththegreats.com and we will make it right.

6. Fair use and acceptable use

Pro’s 1,000 messages a month is a fair-use ceiling designed for human writing, not automated traffic. You agree not to: access the service by scripts or scrapers; resell, share, or pool accounts; probe, overload, or circumvent our security or metering; use the service to generate content that is unlawful, infringing, or intended to deceive — including passing AI output off as the authentic work of a real person; or attempt to extract the underlying models or prompts. We may rate-limit, suspend, or terminate accounts engaged in abuse.

7. Your content and ownership

What you write is yours. As between you and us, you own the messages you send, and — to the extent permitted by applicable law and the nature of AI-generated material — the outputs generated for you. You grant us the limited license needed to operate the service: to store, process, transmit, and display your content to you and to the subprocessors that run the service. We do not train models on your content and we do not publish it. You are responsible for how you use outputs, including checking them before you rely on or republish them.

8. AI output disclaimer

The agents are language models performing a style. Their output may be inaccurate, incomplete, or unsuitable for your purpose, and it is not professional advice of any kind. Style is the product; facts are not guaranteed. Verify anything that matters before you use it.

9. Intellectual property and attribution

Literary Agents is not affiliated with, endorsed by, or sponsored by any author's estate. Author names are used solely to describe literary styles. Every voice is built on its author's public-domain writing.

Voice codenames, the Literary Agents name, our site, and our software are our intellectual property; these Terms grant you use of the service, not ownership of any of it. The literary styles our agents honor come from works in the public domain, which belong to everyone.

10. Termination

You can stop using the service, or delete your account, at any time. We may suspend or terminate the service or your access for breach of these Terms, legal necessity, or discontinuation of the product; if we discontinue the paid service entirely, we will refund the unused portion of any prepaid period. Sections 7–13 survive termination.

11. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that outputs will meet your requirements. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, neither we nor our suppliers are liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total liability for all claims in any 12-month period is capped at the greater of $50 or the amount you paid us in that period. These limits apply regardless of legal theory and even if a remedy fails of its essential purpose.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, excluding its conflict-of-law rules. Before filing a claim, write to us and give us 30 days to resolve the issue informally. Disputes that cannot be resolved informally will be brought in the state or federal courts located in California, and both sides consent to their jurisdiction — except that either side may use small-claims court where eligible.

14. Changes to these Terms

We may revise these Terms as the service evolves. For material changes we will update the date above and notify account holders by email at least 14 days before the changes take effect. Continued use after that date means you accept the revised Terms.
